Amend HB 846, Senate Committee Substitute, as follows: Amend SECTION 11. Section 49.066(a), Water Code, by adding sections (b) and (c) to read as follows: (b) LIABILITY FOR AQUATIC HERBICIDE APPLICATION DEFINITION. In this chapter, "commercially licensed aquatic herbicide applicator" means a person who holds a commercial license or permit issued by the Department of Agriculture under Chapter 76, Agriculture Code, that authorizes the commercial application of aquatic herbicides. (c) LIABILITY FOR DAMAGES FROM AQUATIC HERBICIDE APPLICATION. Except as provided by Chapter 12, Parks and Wildlife Code, a commercially licensed aquatic herbicide applicator contracting with a water district or authority is not liable for damages for personal injury, property damage, or death resulting from the application by the applicator of aquatic herbicide in compliance with applicable law and the terms of the license or permit that exceed $2 million.
