Amend CSHB 1171 by striking SECTION 6 of the bill (Committee
Printing, page 4, lines 9-18) and substituting the following:
      SECTION 6.  Subchapter F, Chapter 401, Health and Safety
Code, is amended by adding Section 401.2081 to read as follows:
      Sec. 401.2081.  UNITED STATES DEPARTMENT OF ENERGY WASTE
DISPOSAL IN A PRIVATE FACILITY.  (a)  In order to protect public or
occupational health and safety or the environment, when issuing a
license to a private entity for the disposal of low-level
radioactive waste the commission shall establish the total level of
radioactivity of wastes that may be received into the private
facility from the United States Department of Energy, which shall,
at the maximum, be twenty percent less than the total radioactivity
of wastes projected to be received pursuant to the Texas Low-Level
Radioactive Waste Disposal Compact, exclusive of radioactivity
which is otherwise exempt or in concentrations existing naturally.
      (b)  The commission shall have licensing authority set forth
in Subchapter K of this chapter regarding the issuance of a license
to a private entity for disposal of low-level radioactive waste.
      (c)  The level of total radioactivity described in Subsection
(a) is a maximum amount.  If necessary to protect public or
occupational health and safety or the environment, the commission
may set an amount of total radioactivity lower than the level
described in Subsection (a).
