Amend HB 1533, on third reading, by striking Subsection (a),
Article 21.56B, Insurance Code, as added by the bill, and
substituting the following:
      (a)  Under a personal automobile insurance policy:
            (1)  the insurer shall notify the insured in writing of
the insured's right to retain at the insured's expense independent
counsel to represent the insured's interests; and
            (2)  the insurer may not offer or provide to the
insured the services of an attorney in the employ of or under
contract to the insurance company in circumstances in which:
                  (A)  a written notification has been given to the
insured which has the effect of reserving the rights of the
insurance carrier to assert any policy provision which would
exclude or deny coverage in whole or in part; or
                  (B)  the amount of damages asserted with respect
to a claim under a policy may reasonably be expected to exceed the
policy limits and a demand for policy limits or more has been made
in writing.
