Amend HB 1713 as follows:
      (1)  In SECTION 1 of the bill, in proposed Section 22.11,
Penal Code, (House Engrossment, page 1, lines 15-20) by striking
subsection (b) and substituting a new subsection (b) to read as
follows:
"(b)  An offense under this section is a felony of the third
degree."
      (2)  In SECTION 1 of the bill, in the proposed Section 22.11,
Penal Code, (House Engrossment) add a new subsection (c) to read as
follows:
"(c)  If conduct constituting an offense under this section also
constitutes an offense under another section of this code, the
actor may be prosecuted under either section.
