      Amend CSSB 4, in SECTION 2.01 of the bill, in added Section
29.155, Education Code (house committee report, page 36, between
lines 18 and 19), by inserting the following:
      (g)  To the extent that money appropriated for purposes of
this section remains available after the commissioner makes grants
for kindergarten and prekindergarten programs, the commissioner may
use the remaining money to provide grants to open-enrollment
charter schools for new facilities used in educating students. The
commissioner may adopt rules governing the award of grants under
this subsection.  The receipt of a grant by an open-enrollment
charter school under this subsection creates a lien in the amount
of the grant in favor of the state against the facility for which
the grant was awarded.  The state may foreclose on the lien if the
charter for the open-enrollment charter school is revoked or the
school otherwise ceases to operate or if the facility otherwise
ceases to be used in educating students under the charter.
