Amend CSSB 89 as follows:
      (1)  Insert the following appropriately numbered section to
the bill and renumber subsequent sections of the bill
appropriately:
      SECTION ____.  Section 43.054(a), Local Government Code, is
amended to read as follows:
      (a)  A municipality with a population of less than 1.6
million may not annex a publicly or privately owned area, including
a strip of area following the course of a road, highway, river,
stream, or creek, unless the width of the area at its narrowest
point is at least 1,000 feet.
      (2)  In SECTION 5 of the bill, in the recital to that section
(Committee Printing page 9, line 23), strike "Section 43.0545" and
substitute "Sections 43.0545 and 43.0546".
      (3)  In SECTION 5 of the bill, after added Section 43.0545,
Local Government Code (Committee Printing page 10, between lines 24
and 25), insert the following:
      Sec. 43.0546.  ANNEXATION OF CERTAIN ADJACENT AREAS BY
POPULOUS MUNICIPALITIES.  (a)  In this section, "municipal area"
means the area within the corporate boundaries of a municipality
other than:
            (1)  an area annexed prior to the effective date of
this section that is less than 1,000 feet wide at any point;
            (2)  an area within the corporate boundaries of the
municipality that was annexed by the municipality prior to the
effective date of this section and at the time of the annexation
the area was contiguous to municipal territory that was less than
1,000 feet wide at any point;
            (3)  an area annexed after December 1, 1995, and before
the effective date of this section;
            (4)  municipally owned property; or
            (5)  an area contiguous to municipally owned property
if the municipally owned property was annexed in an annexation that
included an area that was less than 1,000 feet wide at its
narrowest point.
      (b)  This section applies only to a municipality with a
population of 1.6 million or more.
      (c)  A municipality to which this section applies may not
annex an area that is less than 1,500 feet wide at any point.  At
least 1,500 feet of the perimeter of the area annexed by a
municipality must be conterminous with the boundary of the
municipal area of the municipality.
      (d)  This section does not apply to territory:
            (1)  that is completely surrounded by municipal area;
            (2)  for which the owners of the area have requested
annexation by the municipality;
            (3)  within a district whose elected board of directors
has by a majority vote requested annexation;
            (4)  owned by the municipality; or
            (5)  that contains fewer than 50 inhabitants.
      (4)  In SECTION 16 of the bill, in Subsections (a), (c), and
(g) (Committee Printing, page 37, line 15; page 37, line 21; and
page 39, line 6), correct the references to specific sections of
the bill to take into account the renumbering of the sections of
the bill required by item (1) of this amendment, and in correcting
those references in Subsection (c) include a reference to the
section added by item (1) of this amendment.
      (5)  In SECTION 16(d) of the bill (Committee Printing page
38, line 5), strike "43.0545," and substitute "43.054, 43.0545,
43.0546,".
      (6)  In SECTION 16(e) of the bill (Committee Printing page
38, line 14), strike "43.0545," and substitute "43.054, 43.0545,
43.0546,".
