Amend CSSB 89 as follows:
      (1)  In SECTION 7 of the bill, strike Section 43.0564(a),
Local Government Code (Committee Printing page 8, lines 57-67), and
substitute the following:
      (a)  If the municipality and the representatives of the area
proposed for annexation cannot reach an agreement for  the
provision of services under Section 43.0562, 43.0563, or 43.0751,
either party by majority decision of the party's representatives
may request the appointment of an arbitrator to resolve the service
plan issues in dispute.  The request must be made in writing to the
other party before the 60th day after the date the service plan is
completed under Section 43.056.  The municipality may not annex the
area under another section of this chapter during the pendency of
the arbitration proceeding or an appeal from the arbitrator's
decision.
      (2)  In SECTION 9 of the bill, strike Section  43.0751(o),
Local Government Code (Committee Printing page 11, lines 8-17), and
substitute the following:
      (o)  If a municipality required to negotiate with a district
under this section and the requesting  district fail to agree on
the terms of a strategic partnership agreement, either party may
seek binding arbitration of the issues relating to the agreement in
dispute under Section 43.0564.
