Amend SB 400 as follows:
      (1)  On page 3, line 22 after "department," and before "the"
add the following:  "a juvenile secure pre- or post-adjudication
facility"
      (2)  On page 5, line 14 insert the following:
      SECTION 6, article 62.01, Code of Criminal Procedure, as
added by Chapter 572, Acts of the 72nd Legislature, Regular
Session, 1991, is amended to read as follows:
      (3)  "Penal Institution" means a confinement facility
operated by or under a contract with any division of the Texas
Department of Criminal Justice, a confinement facility operated by
or under contract with the Texas Youth Commission, or a juvenile
secure pre- or post-adjudication facility operated by or under a
local juvenile probation department, or a county jail
