Amend the Counts amendment to CSSB 560 (page 27 of the
packet) as follows:
      (1) In Section 54.2025 (a), Utilities Code, as added by the
amendment, strike "may obtain" and substitute "may request that the
commission grant".
      (2) In Section 54.2025 (a), Utilities Code, as added by the
amendment, strike "so long as" and substitute "to provide
telecommunications services within the municipality, so long as".
      (3) In Section 54.2025 (a), Utilities Code, as added by the
amendment, strike Subdivisions (1)-(3) and substitute the
following:
            (1) in the case of a municipality:
                  (A) the area for which the municipality is
requesting certification is served by a local exchange company with
more than one million access lines in this state; and
                  (B) the municipality does not have a population
more than 70,000; or
            (2) in the case of a municipal electric system;
                  (A) the area for which the municipal electric
system is requesting certification is served by a local exchange
company with more than one million access lines in this state; and
                  (B) the system did not have more than 31,000
customers on December 31, 1990.
      (4) In Section 54.2025, Utilities Code, as added by the
amendment, between existing Subsections (a) and (b), insert a new
Subsection (b) to read as follows:
      (b) Before granting a certificate to a municipality or
municipal electric system under this section, the commission must
find that granting the certificate would be in the public interest.
      (5) In Section 54.2025, Utilities Code, as added by the
amendment, reletter existing Subsection (b) as Subsection (c).
      (6) In Section 54.2025 (c), Utilities Code, as added by the
amendment and relettered by this amendment, strike "unfairly
discriminate or unfairly exercise" and substitute "unfairly or
unreasonably discriminate or unfairly or unreasonably exercise".
