Amend SB 717 on third reading in SECTION 1 of the bill as
follows:
      (1)  In the heading of added Chapter 128, Civil Practice and
Remedies Code, strike "AGAINST FIREARMS OR AMMUNITION MANUFACTURER,
TRADE ASSOCIATION, OR SELLER" and substitute "BY GOVERNMENTAL
UNIT".
      (2)  In added Section 128.001, Civil Practice and Remedies
Code, strike Subsection (b) and substitute the following:
      (b)  Except as provided by Subsection (c), a governmental
unit may not bring suit against:
            (1)  a firearms or ammunition manufacturer, trade
association, or seller for recovery of damages resulting from, or
injunctive relief or abatement of a nuisance relating to, the
lawful design, manufacture, marketing, or sale of firearms or
ammunition to the public; or
            (2)  any manufacturer, as defined by Section 82.001,
for recovery of damages resulting from harm involving public health
or safety.
      (3)  In added Section 128.001(d), Civil Practice and Remedies
Code, strike "firearms manufacturer" and substitute "manufacturer".
      (4)  In added Section 128.001(d)(1), Civil Practice and
Remedies Code, between "ammunition" and "purchased", insert "or any
other product".
      (5)  In added Section 128.001(d)(2), Civil Practice and
Remedies Code, between "ammunition" and ";", insert "or other
product of a manufacturer".
      (6)  In added Section 128.001, Civil Practice and Remedies
Code, add new Subsection (f) as follows:
      (f)  The question of whether an action is for recovery of
damages resulting from harm involving public health or safety under
Subsection (b)(2) shall be determined by the court on a motion of
any party to the action.
