Amend CSSB 766 (House committee report) in Section 5 of the
bill by striking added Subsection (e), Section 382.0519, Health and
Safety Code (page 5, lines 26 and 27, and page 6, lines 1-5) and by
substituting:
      (e) A permit issued under this section for a facility that
annually emits more than 100,000 tons of air contaminants may defer
the implementation of the requirement of reductions in the
emissions of certain air contaminants only if the applicant will
make substantial emissions reductions in other specific air
contaminants.  The commission shall base the deferral on a
prioritization of air contaminants as necessary to meet local,
regional, and statewide air quality needs.  A deferral granted in a
permit under this subsection continues to apply to the facility
even if the facility's emissions fall below the threshold amount
provided by this subsection.
