Amend CSSB 766 (House Committee Report) as follows:
      (1) In Section 5 of the bill, strike added Subsection (b),
Section 382.0519, Health and Safety Code (page 5, lines 10-16), and
substitute:
      (b) The commission shall grant within reasonable time a
permit under this section if, from the information available to the
commission, including information presented at any public hearing
or through written comment, the commission finds that:
            (1) the facility will use an air pollution control
method at least as beneficial as that described in Section 382.003
(9) (E) (ii), considering the age and remaining useful life of the
facility, except as provided by Subdivision (2); or
            (2) the facility will use the best available control
technology, considering the age and remaining useful life of the
facility and the technical practicability and economic
reasonableness of reducing or eliminating the emissions resulting
from the facility if the facility:
                  (A) emits more than 200 tons of air contaminants
annually; and
                  (B) is located in:
                        (i) Bosque, Coryell, El Paso, Hood, Parker,
Somervell, or Wise County;
                        (ii) a county traversed by any part of
Interstate Highway 35 north of the city of San Antonio;
                        (iii) a county traversed by any part of
Interstate Highway 37 south of the city of San Antonio; or
                        (iv) a county located east of a county
described by Subparagraph (ii) or (iii).
      (2) Add a new section to the bill, appropriately numbered to
read:
      SECTION _____.  To the extent that Section 382.0519, Health
and Safety Code, as added by this Act, conflicts with another law
enacted by the 76th Legislature specifically regarding emissions
reduction requirements for electric generating facilities, the
other law prevails over Section 382.0519.
      (3) Renumber the Sections of the bill appropriately.
