Amend CSSB 766 (House Committee Report) as follows:
      (1)  In Section 5 of the bill, in added Section 382.05193,
Health and Safety Code:
            (A)  In the heading of that section (page 7, lines
2-3), strike "ENVIRONMENTAL MITIGATION" and substitute "EMISSIONS
REDUCTION".
            (B)  Strike Subsection (b) of that section (page 7,
lines 15-22) and substitute:
      (b)  The commission by rule shall establish a program to
grant emissions reduction credits to a facility if the owner or
operator conducts an emissions reduction project to offset the
facility's excessive emissions.  To be eligible for a credit to
offset a facility's emissions, the emissions reduction project must
reduce emissions in the airshed, as defined by commission rule, in
which the facility is located.
            (C)  In Subsection (c) of that section (page 7, lines
23-24), strike "A project included in the emissions reduction
projects category" and substitute "The commission by rule shall
provide that an emissions reduction project".
            (D)  In Subsection (c) of that section (page 8, line
1), strike "The emissions reduction projects category" and
substitute "Qualifying emissions reduction projects".
            (E)  Strike Subsection (d) of that section (page 8,
line 20, through page 9, line 5).
            (F)  Redesignate:
                  (i)  Subsection (e) of that section (page 9, line
6) as Subsection (d);
                  (ii)  Subsection (f) of that section (page 9,
line 11) as Subsection (e); and
                  (iii)  Subsection (g) of that section (page 9,
line 21) as Subsection (f).
      (2)  Add a new section to the bill, appropriately numbered,
to read:
      SECTION ____.  To the extent that Section 382.05193, Health
and Safety Code, as added by this Act, conflicts with another law
enacted by the 76th Legislature specifically regarding emissions
reduction requirements for electric generating facilities, the
other law prevails over Section 382.05193.
      (3)  Renumber the subsequent sections of the bill
accordingly.
