Amend CSSB 962 on page 2 by striking lines 24 and 25 and
inserting the following:
      unless:
            (1) the defendant has previously been convicted under
this section; or
            (2) the person against whom the offense was committed
was intentionally selected because of the defendant's bias or
prejudice against a group, if the group is a group for which
statistics of crimes motivated by prejudice, hatred, or advocacy of
violence toward that group are required to be maintained under
Section 411.046 (a), Government Code; in which event the offense is
a Class A misdemeanor.
