Amend SB 1230 as follows:
      (1)  In SECTION 4 of the bill, in added Subchapter A, Chapter
45, Code of Criminal procedure (House Committee Printing, page 3,
between lines 15 and 16), insert the following:
      Art. 45.003.  DEFINITION. In this chapter, "day" does not
include Saturday, Sunday, or a legal  holiday.
      (2)  Add the following appropriately numbered SECTIONS to the
bill:
      SECTION ____.  Subchapter B, Chapter 45, Code of Criminal
Procedure, is amended by adding Article 45.013 to read as follows:
      Art. 45.013.  FILING WITH CLERK BY MAIL. (a)  Notwithstanding
any other law, for the purposes of this chapter a document is
considered timely filed with the clerk of a court if:
            (1)  the document is deposited with the United States
Postal Service in a first class postage prepaid envelope properly
addressed to the clerk on or before the date the document is
required to be filed with the clerk; and
            (2)  the clerk receives the document not later than the
10th day after the date the document is required to be filed with
the clerk.
      (b)  A legible postmark affixed by the United States Postal
Service is prima facie evidence of the date the document is
deposited with the United States Postal Service.
      SECTION ____.  Article 45.013, Code of Criminal Procedure, as
added by this Act, applies only to  a document required to be filed
on or after the effective date of this Act.
      (3)  Renumber the remaining SECTIONS of the bill accordingly.
