Amend CSSB 1384 as follows:
1.  Strike lines 38 through 41 on Page 1 of the Committee Report
and insert in lieu thereof the following:
      (5)  may intervene as a matter of right or otherwise appear
in a judicial proceeding that affects the rates or services
applicable to residential consumers, as a class, including but not
limited to proceedings involving the constitutionality,
applicability or construction of a statute and proceedings arising
out of an investigation or informal proceeding of an administrative
agency;
2.  Amend Section 13.003, Utilities Code, by adding a new
subsection (d) to read as follows:
      (d)  This subsection shall not limit the authority of the
office to participate in any judicial proceeding as provided by
subsections (a)(1) through (a)(4).  The authority conferred by
subsection (a)(5) shall not include the right to intervene or
otherwise appear in a judicial proceeding involving:
      (1)  the terms and conditions of employment by or with a
utility;
      (2)  a dispute involving an individual customer of a utility,
except as provided by subsection (a)(8);
      (3)  a private dispute between telecommunications providers
and suppliers not affecting rates and services;
      (4)  a dispute regarding a contract between a municipality
and a telecommunications provider for municipal franchise fees,
except as provided by Subsection (a)(4); or
      (5)  interconnection agreements between telecommunications
providers, except as provided by Subsection (a)(4).
3.  Insert between lines 54 and 55 on page 1 of the Committee
Report a new SECTION and renumber subsequent SECTIONS
appropriately, with the new SECTION to read as follows:
      SECTION ____.  (a)  Except as provided by subsection (b),
this Act is effective September 1, 1999.
      (b)  Section 13.003(a)(5), Utilities Code, applies only to a
judicial proceeding initiated on or after September 1, 1999.
