Amend SB 1525 on Third Reading as follows:
      (1)  Insert a new SECTION in the bill, appropriately
numbered,  as follows:
      SECTION ____.  Section 15, Licensed Dietitian Act (Article
4512h, Vernon's Texas Civil Statutes), is amended by amending
Subsection (c) and adding Subsection (d) to read as follows:
      (c)  Unless the person is licensed under this Act, a person
may not for compensation provide nutrition services or hold that
person out as authorized by law to provide nutrition services.
      (d)  A person commits an offense if the person knowingly or
intentionally violates Subsection (a), <or> (b), or (c) of this
section.  An offense under this section is a Class B misdemeanor.
      (2)  Insert the following new SECTION to the bill,
appropriately numbered:
      SECTION ____.  The Licensed Dietitian Act (Article 4512h,
Vernon's Texas Civil Statutes) is amended by adding Section 15B to
read as follows:
      Sec. 15B.  NUTRITION SERVICES EXEMPTIONS.  This Act does not
apply to the provision of nutrition services by:
            (1)  other licensed health care professionals,
including physicians, dentists, chiropractors, registered nurses,
and licensed vocational nurses, if the activities are permitted by
the law under which the professional is licensed and the licensed
professional does not represent that the professional is a licensed
dietitian or authorized by law to provide nutrition services;
            (2)  a student, intern, or provisional licensed
dietitian who is enrolled in training or in a course of study at a
regionally accredited institution of higher education and who is
under the supervision and direction of a licensed dietitian while
engaged in activity related to the training or course of study;
            (3)  a dietetic technician or dietary manager while
practicing under the supervision of a licensed dietitian;
            (4)  a person employed as a dietitian or nutritionist
by a governmental agency or regionally accredited institution of
higher education while the person is performing duties within the
scope of the person's employment; or
            (5)  a person performing voluntary activities or who is
acting  within the scope of the person's employment by a
charitable, nonprofit organization if the person does not represent
that the person is a licensed dietitian or authorized by law to
provide nutrition services.
      (3)  Renumber the SECTIONS of the bill accordingly.
