Amend CSSB 1787, Senate Committee Printing, as follows: (1) Insert the following new ARTICLE 5 and redesignate the subsequent ARTICLES of the bill accordingly: ARTICLE 5. INSURANCE AVAILABILITY SECTION 5.01. Article 21.81, Chapter 21, Insurance Code, is amended adding a new Sec. 4(c) and Sec. 4(d) to read as follows: (c) Notwithstanding Section 5 of this article, an applicant is eligible for insurance through the association if the applicant and servicing agent certify that the applicant is unable to find coverage at a rate that is within the benchmark flexibility band, pursuant to Art. 5.101 of this Code and the applicant is a good driver. Such an applicant shall be charged a rate for coverage that does not exceed a rate that is greater than the midway point between 115 percent of the benchmark rate promulgated pursuant to Art. 5.101 of this Code and the rate promulgated under Section 5 of this article. The commissioner may make rules to implement this section. (d) In this section, a "good driver" means an individual who: (1) is over the age of: (A) if male, 25 years of age; and (B) if female, 21 years of age; (2) has been licensed for at least three years to drive the type of motor vehicle to be insured; (3) during the previous three years, has not: (A) been at fault in a motor vehicle accident that resulted in bodily injury, death, or property damage; (B) been convicted of a violation of a traffic safety regulation that involved a moving vehicle; or (C) been convicted of an offense under Section 49.04, Penal Code, or Section 106.041, Alcoholic Beverage Code; (4) has never made a fraudulent insurance claim; and (5) does not drive a sports or high-performance vehicle. (2) On page 11, between line 11-39 and 11-40, insert the following new SECTION 6.03 and SECTION 6.04 and renumber the subsequent SECTIONS: SECTION 6.03. Subsections 4(c) and 4(d) of Article 21.81, Insurance Code, as added by this Act, apply only to a motor vehicle liability insurance policy that is delivered, issued for delivery, or renewed on or after January 1, 2001. A policy that is delivered, issued for delivery, or renewed before January 1, 2001, is governed by the law as it existed immediately before the effective date of this Act, and that law is continued in effect for that purpose. SECTION 6.04. The provisions of Subsections 4(c) and 4(d) of Article 21.81, Insurance Code, as added by this Act, expire January 1, 2003.
