BACKGROUND AND PURPOSE 

Currently, the statute of limitations to enforce the specific performance
of a real estate sales contract is four years from the day the cause of
action accrues.  H.B. 29 shortens the period of time within which a person
may seek specific performance of a real estate sales contract from four
years to one year. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Subchapter B, Chapter 16, Civil Practice and Remedies
Code, by adding Section 16.038, to require that a person bring suit for the
specific performance of a real estate sales contract no later than one year
after the day the cause of action accrues.   

SECTION 2.  Effective date:  September 1, 1999.  
                       Makes application of this Act prospective.

SECTION 3.  Emergency clause.
