HBA-NMO H.B. 33 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 33 By: Goolsby Higher Education 3/11/1999 Committee Report (Amended) BACKGROUND AND PURPOSE Currently, the state seal of Texas is not required to be placed on the athletic uniforms of the state's public universities and colleges. At the same time, as a form of advertisement, corporations are paying to have their logos placed on intercollegiate athletic uniforms. H.B. 33 requires intercollegiate teams organized by Texas public senior colleges or universities to display the state seal on their uniforms. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter Z, Chapter 51, Education Code, by adding Section 51.9246, as follows: Sec. 51.9246. DISPLAY OF STATE SEAL ON ATHLETIC TEAM UNIFORMS. Defines "general academic teaching institution." Requires an intercollegiate athletic team organized by a public senior college or university to affix a representation of the state seal on each team participant's uniform. Specifies the seal be visible to spectators and be placed prominently on the uniform. Specifies the seal be at least as large as any other logo, representation, or symbol on the uniform, other than that of the college or university, the team name, or the number or name identifying the participant. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause. EXPLANATION OF AMENDMENTS Committee Amendment #1 SECTION 1. Requires the state seal to be affixed in conformance with the rules of the national association for the promotion and regulation of intercollegiate athletics of which the institution is a member.
