HBA - NMO, RBT H.B. 57 76(R)BILL ANALYSIS Office of House Bill AnalysisH.B. 57 By: Cuellar Judicial Affairs 9/30/1999 Enrolled BACKGROUND AND PURPOSE Prior to the 76th Legislature, the secretary or clerk of a municipality could not administer oaths and give certificates of the fact. H.B. 57 authorizes the secretary or clerk of a municipality to administer oaths and give certificates of the fact in a matter pertaining to the official business of the municipality. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 602.002, Government Code, to include a secretary or clerk of a municipality in a matter pertaining to the official business of the municipality in the list of officials who are authorized to administer and give a certificate of the fact to an oath made in this state. SECTION 2. Emergency clause. Effective date: upon passage
