RBT C.S.H.B. 57 76(R) BILL ANALYSIS Office of House Bill AnalysisC.S.H.B. 57 By: Cuellar Judicial Affairs 3/9/1999 Committee Report (Substituted) BACKGROUND AND PURPOSE Currently, the secretary or clerk of a municipality cannot administer oaths and give certificates of the fact. C.S.H.B. 57 authorizes the secretary or clerk of a municipality to administer oaths and give certificates of the fact in a matter pertaining to the official business of the municipality. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 602.002, Government Code, to include a secretary or clerk of a municipality in a matter pertaining to the official business of the municipality in the list of officials who are authorized to administer and give a certificate of the fact to an oath made in this state. SECTION 2. Emergency clause. Effective date: upon passage COMPARISON OF ORIGINAL TO SUBSTITUTE C.S.H.B. 57 authorizes the secretary or clerk of a municipality to administer oaths and give certificates of the fact but limits that authority to a matter pertaining to the official business of the municipality. H.B. 57 did not contain the limitation.
