BACKGROUND AND PURPOSE
Currently, the secretary/clerk of a municipality cannot administer oaths
and give certificates of the fact. H.B. 57 authorizes the secretary/clerk
to administer oaths and give certificates of the fact.
RULEMAKING AUTHORITY
It is the opinion of the Office of House Bill Analysis that this bill does
not delegate any additional rulemaking authority to a state officer,
department, agency, or institution.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 602.002, Government Code, to include a secretary
or clerk of a municipality in the list of officials who are authorized to
administer and give a certificate of fact to an oath made in this state.
SECTION 2. Emergency clause.
Effective date: upon passage
