DIGEST 

Currently, the Texas Department of Criminal Justice (TDCJ) is authorized to
use surplus agricultural capacity to provide agricultural products for
nonprofit organizations.  H.B. 128 would establish conditions regarding the
participation of TDCJ in certain food bank programs. 

PURPOSE

As proposed, H.B. 128 establish conditions regarding the participation of
the Texas Department of Criminal Justice in certain food bank programs. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 497.113, Government Code, by adding Subsection
(d), to provide that TDCJ is encouraged to enter into agreements with
nonprofit food banks.  Authorizes an agreement under this section to
provide seed and fertilizer to TDCJ and TDCJ will in turn supply to the
food bank agricultural products grown from the seeds with assistance from
the fertilizer.  Defines "nonprofit food bank." 

SECTION 2.  Emergency clause.
            Effective date: upon passage.
