HBA-NMO H.B. 212 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 212 By: Hochberg Criminal Jurisprudence 2/8/1999 Introduced BACKGROUND AND PURPOSE Currently, if a jury recommends community supervision, the judge must abide by the jury's recommendation. H.B. 212 provides that a person convicted of murder is not eligible for community supervision. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 4(d), Article 42.12, Code of Criminal Procedure, to provide that a defendant is not eligible for community supervision if the defendant is convicted of murder. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 1999. SECTION 4. Emergency clause.
