SRC-AXB H.B. 236 76(R) BILL ANALYSIS Senate Research Center H.B. 236 76R9244 DRH-DBy: Krusee (Wentworth) Infrastructure 5/3/1999 Engrossed DIGEST Currently, the Municipal Utility District (MUD) of Wells Branch could cast a vote for the Williamson County representative on the Austin Capital Metropolitan Transit Authority (CapMetro) board, even though no part of Wells Branch that lies in Williamson County lies within the CapMetro service district. Wells Branch currently is represented by the Travis County board member. H.B. 236 clarifies the MUD boundaries which determine eligibility for CapMetro board membership. PURPOSE As proposed, H.B. 236 specifies the municipal utility district (MUD) boundaries which determine eligibility for the presiding officer of the MUD to be on the board of directors of certain metropolitan rapid transit authorities. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 451.5021, Transportation Code, by amending Subsection (b), and adding Subsection (g), to provide that one member appointed to the governing board of an authority is appointed by a panel composed of certain mayors, county judges, and the presiding officer of each municipal utility district that has a majority of its territory, rather than any portion, located outside the principal county, and is located wholly or partly in the authority. Provides that this section continues to apply to the governing body of an authority, even if a change occurs in the method of electing the members. SECTION 2. Emergency clause. Effective date: upon passage.
