DIGEST 

Currently, Texas law authorizes peace officers to administer certain oaths.
H.B. 243 would authorize a peace officer to administer an oath while
engaged in the performance of the officer's duties and to give a
certificate of fact in this state. 

PURPOSE

As proposed, H.B. 243 authorizes a peace officer to administer an oath
while engaged in the performance of the officer's duties and to give a
certificate of fact in this state. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 602.002, Government Code, to authorize an oath
made in this state to be administered and a certificate of the fact given
by a peace officer described by Article 2.12, Code of Criminal Procedure,
if the oath is administered when the officer is engaged in the performance
of the officer's duties, and the administration of the oath relates to the
officer's duties. 
Makes conforming changes.

SECTION 2. Emergency clause.
           Effective date: upon passage.
