HBA-RBT H.B. 507 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 507 By: Wohlgemuth Criminal Jurisprudence 4/7/1999 Introduced BACKGROUND AND PURPOSE The 75th Legislature placed a limit on how much money smaller municipalities could collect in court costs for violations of Section 545.066, Transportation Code (Passing a School Bus; Offense), within a school crossing zone. H.B. 507 removes that limit in order to allow these communities to raise money which may be used to fund school crossing guard programs in the county where they are collected, and if no crossing guard programs exist, the funds may be used for other statutorily authorized purposes. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 102.014(c), Code of Criminal Procedure, to require that specified court costs be assessed in all municipalities, rather than only in municipalities with a population of 400,000 or more. SECTION 2. Makes application of this Act prospective. SECTION 3. Emergency clause. Effective date: upon passage.
