HBA-PDH H.B. 514 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 514 By: Gray Urban Affairs 2/11/1999 Introduced BACKGROUND AND PURPOSE Currently, a tenant is allowed to serve on a local housing authority, but the tenant is limited to one term. This may have the effect of inhibiting tenant representation in smaller communities with fewer potential representatives from which to draw. H.B. 514 allows a tenant commissioner in a municipality of less than 75,000 to serve consecutive terms. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 392.0331 (f), Local Government Code, by exempting a commissioner appointed by a municipality with a population of less than 75,000 from the prohibition against serving consecutive terms. SECTION 2. Makes application of this Act retroactive regarding a commissioner appointed under Section 392.0331 (Appointment of Tenant Representative as Commissioner of Municipal, County, or Regional Housing Authority), Local Government Code. SECTION 3. Emergency clause. Effective date: upon passage.
