BACKGROUND AND PURPOSE 

Currently, Texas law requires every male between the ages of 18 and 26
residing in the United States, other than those granted nonimmigrant
status, to register with the selective service system. There are specific
penalties under the law for failure to register, including fines and
imprisonment. H.B. 558 requires proof of registration with or exemption
from the selective service to qualify for employment with any branch of
state government.  

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Chapter 651, Government Code, by adding Section 651.005,
as follows: 

Sec. 651.005.  REQUIREMENT OF SELECTIVE SERVICE REGISTRATION OR EXEMPTION.
Prohibits an agency in any branch of state government from hiring a person
as an employee if the person is of the age and gender that would require a
citizen of the United States to register with the selective service system
under federal law, unless the person presents proof of the person's
registration with the selective service system as required by federal law,
or proof of the person's exemption from registration with the selective
service system.  Provides that this section does not apply to a person
employed by a state agency before September 1, 1999, as long as the
person's employment by the agency is continuous. 

SECTION 2.  Effective date: September 1, 1999.

SECTION 3.  Emergency clause.
