HBA-NLM H.B. 578 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 578 By: Giddings Public Education 4/20/1999 Introduced BACKGROUND AND PURPOSE Current law does not require instruction in the principles and techniques of cardiopulmonary resuscitation among the required health curriculum. H.B. 578 provides that specific instruction in the principles and techniques of cardiopulmonary resuscitation must be given at least once at the seventh grade level or above. In addition, H.B. 578 provides that a school district employee who serves as a coach or assistant coach for certain extracurricular athletic activities must submit to the district proof of current certification in first aid and cardiopulmonary resuscitation issued by the American Red Cross, the American Heart Association, or another organization that provides equivalent training and certification. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 28.002 (a), Education Code, to include specific instructions in the principles and techniques of cardiopulmonary resuscitation given at least once at the seventh grade level or above among the required health curriculum. SECTION 2. Amends Subchapter D, Chapter 33, Education Code, by adding Section 33.086, as follows: Sec. 33.086. CERTIFICATION IN CARDIOPULMONARY RESUSCITATION AND FIRST AID. Provides that a school district employee who serves as a coach or assistant coach for an extracurricular athletic activity sponsored or sanctioned by a school district or the University Interscholastic League, must submit to the district proof of current certification in first aid and cardiopulmonary resuscitation issued by the American Red Cross, the American Heart Association, or another organization that provides equivalent training and certification. Requires each school district to adopt procedures for administration of this section including the time and manner in which proof of current certification must be submitted. SECTION 3. (a) Provides that Section 28.002 (a)(2)(B), Education Code, as amended by this Act, applies beginning with the 1999-2000 school year. (b) Provides that Section 33.086, Education Code, as added by this Act, applies beginning January 1, 2000. SECTION 4. Emergency clause. Effective date: upon passage.
