HBA-RBT H.B. 650 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 650 By: Danburg Criminal Jurisprudence 4/9/1999 Introduced BACKGROUND AND PURPOSE Studies show that the amount and severity of injuries increase when resistance is offered. H.B. 650 provides that a sexual act occurs without a person's consent if the person expresses through words or conduct that the person does not consent. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 22.011(b), Penal Code, to include in the list of circumstances which do not constitute consent to a sexual assault an expression by words or conduct that the other person does not consent to the act. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 1999. SECTION 4. Emergency clause.
