H.B. 703 permits purchase of lottery tickets only by U.S. currency, checks, debit cards, vouchers or coupons issued by the Texas Lottery Commission, and mail order subscriptions authorized by the commission. PURPOSE As proposed, H.B. 703 permits purchase of lottery tickets only by U.S. currency, checks, debit cards, vouchers or coupons issued by the Texas Lottery Commission, and mail order subscriptions authorized by the commission. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 466.3052, Government Code, as follows: Sec. 466.3052. New heading: PURCHASE AND SALE OF TICKETS. Provides that a person commits an offense if the person intentionally or knowingly sells a ticket and the person accepts as payment anything other than United States currency, a negotiable instrument in the form of a check, a debit made through a financial institution debit card, a coupon or voucher issued by the Texas Lottery Commission (commission) for purposes of purchasing a lottery ticket, or a mail order subscription on a mail order subscription form authorized by the commission. Deletes existing text regarding food stamps, credit and debit cards, sales made over the phone, and mail order sales. SECTION 2. Effective date: September 1, 1999. SECTION 3. Makes application of this Act prospective. SECTION 4. Emergency clause.
