Legislation passed by the 74th Legislature to establish the board's current composition mistakenly applied only to Mitchell County. H.B. 774 would include Fisher and Nolan counties in the board's composition. PURPOSE As proposed, H.B. 774 establishes conditions regarding the juvenile board in Fisher, Mitchell, and Nolan counties. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 152.0821, Human Resources Code, by amending Subsections (a), (b), and (c) and by adding Subsections (f) and (g), to provide that Fisher County is included in the Fisher, Mitchell, and Nolan counties juvenile board (board). Sets forth the individuals that compose the board. Provides that the chairman of the board is the county judge appointed under Subsection (a)(1). Establishes that each member serves two years. Authorizes the board member from the Sweetwater City Commission to be appointed only if the City of Sweetwater agrees to provide funds for the salaries of personnel assigned to Nolan County and other expenses to provide adequate juvenile services to Nolan County. Authorizes the member appointed by the Sweetwater Independent School District to be appointed only if that school district agrees to provide certain funds for juvenile services to Nolan County. Deletes text regarding certain individuals included in the composition of the board, and a majority vote to elect a chairman annually. SECTION 2. Amends Section 152.1831, Human Resources Code, by amending Subsections (a), (b), and (c) and by adding Subsections (f) and (g), to provide that Nolan County is included in the Fisher, Mitchell, and Nolan counties juvenile board. Makes conforming changes. SECTION 3. (a) Effective date: September 1, 1999. (b) Provides that the terms of the members of the Juvenile Board of Fisher County who are serving immediately before the effective date of this Act expire on that date. Requires members of the Juvenile Board of Fisher County to be appointed in accordance with this Act, as soon as possible after the effective date. (c) Provides that the terms of the members of the Juvenile Board of Nolan County who are serving immediately before the effective date of this Act expire on that date. Requires members of the Juvenile Board of Nolan County to be appointed in accordance with this Act, as soon as possible after the effective date. SECTION 4. Emergency clause.
