HBA-RBT H.B. 860 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 860 By: Dukes Criminal Jurisprudence 4/23/1999 Introduced BACKGROUND AND PURPOSE Currently, licensed concealed handguns are banned from school premises. The definition of "school premises" does not include public or private driveways, streets, sidewalks or walkways, parking lots, parking garages, or other parking areas. H.B. 860 includes such areas in the definition of "school premises." RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 46.03(c), Penal Code, to redefine "premises" to include any public or private driveway, street, sidewalk or walkway, parking lot, parking garage, or other parking area for the third degree felony of possessing a prohibited weapon on school premises. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 1999. SECTION 4. Emergency clause.
