DIGEST 

Currently, Texas law allows certain fees to be applied to the interest
earned from court-held accounts.  However, this may cause hardships in
certain funds.  H.B. 870 would establish provisions regarding county fees
for handling certain registry funds. 

PURPOSE

As proposed, H.B. 870 exempts the withdrawal of funds generated from a case
arising under the Family Code from the deduction of fees. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 117.055(a), Local Government Code, to provide
that withdrawal of funds generated from a case arising under the Family
Code is exempt from the fee deduction provided by this section. 

SECTION 2.  Effective date: September 1, 1999.
            Makes application of this Act prospective.

SECTION 3.  Emergency clause.
