HBA-MPM H.B. 877 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 877 By: Hochberg Public Education 4/21/1999 Introduced BACKGROUND AND PURPOSE Currently, the numerical progress of students on subsequent assessment instruments required under Section 39.023 (Adoption and Administration of Instruments), Education Code, is not included for students who fail to perform satisfactorily among other factors on which the academic excellence indicators must be based. H.B. 877 includes the numerical progress of students on such assessment instruments, aggregated by grade level and subject area, for students who fail to perform satisfactorily on those assessments, among other factors on which academic excellence indicators must be based. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sections 39.051(b) and (d), Education Code, to include the numerical progress of students on subsequent assessment instruments required under Section 39.023(a) and (b) (Adoption and Administration of Instruments), aggregated by grade level and subject area, for students who fail to perform satisfactorily on those assessments, among other factors on which academic excellence indicators must be based. Redesignates Subdivision (b)(7)-(b)(9) to Subdivision (b)(8)-(b)(10), respectively. Makes a conforming change. SECTION 2. Amends Section 39.052(b), Education Code, to make a conforming change. SECTION 3. Amends Sections 39.072(b) and (c), Education Code, to make conforming changes. SECTION 4. Amends Section 39.073(a), Education Code, to make a conforming change. SECTION 5. Amends Section 39.074(e), Education Code, to make a conforming change. SECTION 6. Effective date: September 1, 1999. SECTION 7. Emergency clause.
