HBA-RBT H.B. 881 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 881 By: Walker Criminal Jurisprudence 2/19/1999 Introduced BACKGROUND AND PURPOSE Currently, a person cannot serve as a grand juror if the person is under indictment for theft or other legal accusation for theft or of any felony, but does not include a person who has been convicted. H.B. 881 disqualifies those individuals convicted of theft from grand jury service. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 19.08, Code of Criminal Procedure, to include a conviction for theft among the convictions which disqualify a person from service on a grand jury. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 1999. SECTION 4. Emergency clause.
