HBA-MPA H.B. 953 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 953 By: Uher Public Safety 4/5/1999 Introduced BACKGROUND AND PURPOSE Currently, a student who is required to complete a driver education course to obtain a Class C license may be given approval by the Department of Public Safety to learn how to drive under the instruction of a parent or legal guardian. The instructor must meet criteria laid down by the department for conducting the driver education course. H.B. 953 allows the grandparent of such a student to instruct the student, provided that all relevant guidelines have been met. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that rulemaking authority previously delegated to the Department of Public Safety is modified in SECTION 1 (Section 521.205, Transportation Code) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 521.205(a), Transportation Code, to add the grandparent of the student to the list of persons who may instruct a student who is required to complete a driver education course to obtain a Class C license under this section. Makes conforming and nonsubstantive changes. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
