DIGEST 

Currently, the authority of the City of Lubbock to lease land designated as
parkland to a private entity for certain development is unclear.  The City
of Lubbock would like to lease land designated as parkland to a private
entity for development into marina/housing facilities.  This bill would
clarify the authority to lease or develop the Sam Wahl Recreation Area.    

PURPOSE

As proposed, H.B. 960 establishes the regulation of the Sam Wahl
Recreation Area at Lake Alan Henry. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Chapter 231G, Local Government Code, by adding Section
231.141, as follows: 

Sec. 231.141.  REGULATION OF SAM WAHL RECREATION AREA.  Authorizes the
commissioners court of Garza County to zone for commercial or residential
development the area adjacent to Lake Alan Henry known as the Sam Wahl
Recreation Area.  Authorizes a municipality owning property in the Sam Wahl
Recreation Area to develop, change the use of, or dispose of the property,
notwithstanding this chapter, Chapter 253, or other law. 

SECTION 2.  Effective date: September 1, 1999.

SECTION 3.  Emergency clause.
