BACKGROUND AND PURPOSE

Chapter 231, Local Government Code, allows the commissioners court of Garza
County to zone a prescribed area around Lake Alan Henry. Currently, these
zoning regulations must be designed to facilitate the adequate provision of
transportation, water, sewers, parks, and other public requirements, and to
assist in developing the area into parks, playgrounds, and recreational
areas. In accordance with this statute, the Sam Wahl Recreation Area has
been developed at Lake Alan Henry. Garza County and the City of Lubbock
would like to be able to encourage further commercial and residential
development of this area. H.B. 960 authorizes the commissioners court of
Garza County to zone the Sam Wahl Recreation Area for commercial or
residential development.

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
