HBA-MPM H.B. 1113 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1113 By: Farabee Public Education 4/20/1999 Introduced BACKGROUND AND PURPOSE Current law does not prohibit a company or organization from distributing to, selling to, or grading the same assessment instrument form for a school district for more than a certain number of concurrent school years. H.B. 1133 prohibits a company or organization from distributing to, selling to, or grading for the same school district, the same assessment instrument form for more than six school years, rather than three school years, and prohibits a district from using the same assessment instrument form for more than six years, rather than three years. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 39.032(a), Education Code, to prohibit a company or organization from distributing to, selling to, or grading for the same school district, the same assessment instrument form for more than six school years, rather than three school years. Prohibits a district from using the same assessment instrument form for more than six years, rather than three years. SECTION 2. Provides that this Act applies beginning with the 1999-2000 school year. SECTION 3. Emergency clause. Effective date: upon passage.
