BACKGROUND AND PURPOSE 

The Greater Kelly Development Corporation (GKDC) is the local redevelopment
authority created by the City of San Antonio to develop a major industrial
tract of land owned by the Air Force, once the Air Force abandons use of
the property.  The city desires the ability to convey to GKDC property
which abuts the area being developed by GKDC.  The city would also like the
authority to convey the property at less than fair market value, and it is
not clear that the city has the authority to do so. H.B. 1125 provides for
the conveyance of property to a municipally created development corporation
if the property is adjacent to the area designated to be developed by the
corporation.  The bill will also resolve and clarify a city's authority to
convey property at less than fair market value. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Chapter 253, local Government Code, by adding Section
253.009, as follows: 

Sec. 253.009.  CONVEYANCE OF ADJOINING PROPERTY TO MUNICIPAL DEVELOPMENT
CORPORATION.  Authorizes a municipality to convey real property that is
adjacent to an area designated for development by a municipally created
economic development corporation, including one organized under the
Development Corporation Act of 1979 (Article 5190.6, V.T.C.S.), to that
corporation.  Authorizes a municipality to convey property under this
section for any fair consideration, provided that the governing body adopts
an ordinance describing the property to be conveyed and stating the
consideration paid.  Authorizes a municipality to convey the property
without complying with the other notice or bidding requirements in Section
272.001 (Notice of Sale or Exchange of Land by Political Subdivision;
Exceptions). 

SECTION 2.  Emergency clause.
  Effective date: upon passage.
