This provision does not take into account the advanced academic training and residency requirements of certain licensed professionals. H.B. 1145 would regulate the continuing education requirements for a licensed chemical dependency counselor. PURPOSE As proposed, H.B. 1145 regulates the continuing education requirements for a licensed chemical dependancy counselor. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 15, Chapter 635, Article 4512o, V.T.C.S., to require a person licensed under this Act, except as provided by Subsection (c) of this section, to complete at least 60 hours of continuing education in each two-year period in which the person holds a license. Requires a person under this Act to whom this subsection applies to complete at least 24 hours of continuing education in each two-year period in which the person holds a license as a requirement for the renewal of the license. Sets forth certain license holders who are subject to this subsection. Prohibits the Texas Commission on Alcohol & Drug Abuse (commission), except for the number of hours required, from adopting a rule that distinguishes between the continuing education requirements required for a license holder subject to Subsections (b) and (c) of this section. SECTION 2.Effective date: September 1, 1999. Makes application of this Act prospective. SECTION 3.Emergency clause.
