DIGEST 

Currently, a licensed chemical dependency counselor must complete 60 hours
of continuing education in each two-year period in which the person holds a
license as a requirement for the renewal of the license.  This provision
does not take into account the advanced academic training and residency
requirements of certain licensed professionals.  H.B. 1145 would regulate
the continuing education requirements for a licensed chemical dependency
counselor. 


PURPOSE

As proposed, H.B. 1145 regulates the continuing education requirements for
a licensed chemical dependancy counselor. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 15, Chapter 635, Article 4512o, V.T.C.S., to
require a person licensed under this Act, except as provided by Subsection
(c) of this section, to complete at least 60 hours of continuing education
in each two-year period in which the person holds a license.  Requires a
person under this Act to whom this subsection applies to complete at least
24 hours of continuing education in each two-year period in which the
person holds a license as a requirement for the renewal of the license.
Sets forth certain license holders who are subject to this subsection.
Prohibits the Texas Commission on Alcohol & Drug Abuse (commission), except
for the number of hours required, from adopting a rule that distinguishes
between the continuing education requirements required for a license holder
subject to Subsections (b) and (c) of this section. 

SECTION 2.Effective date: September 1, 1999.
  Makes application of this Act prospective.

SECTION 3.Emergency clause.
