HBA-ALS H.B. 1150 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1150 By: Dukes Licensing & Administrative Procedures 3/23/1999 Introduced BACKGROUND AND PURPOSE Under current law, the Texas Alcoholic Beverage Commission (commission) may suspend or cancel a permittee's license to sell alcoholic beverages if it finds that the permittee has discriminated against an individual on the basis of race, color, creed, or national origin. H.B. 1150 adds discrimination on the basis of gender, religion, and disability to the list of convictions warranting the suspension or cancellation of a permit to sell alcoholic beverages. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 11.611, Alcoholic Beverage Code, to authorize the Texas Alcoholic Beverage Commission (commission) to suspend for no more than 60 days or cancel a permit if it is found after notice and hearing that the permittee has been finally convicted under a law prohibiting discrimination against an individual based on the individual's disability, religion, or sex, rather than the individual's creed. SECTION 2.Amends Section 61.711, Alcoholic Beverage Code, to make conforming changes. SECTION 3.Amends Section 109.56, Alcoholic Beverage Code, to make conforming changes. SECTION 4.Effective date: September 1, 1999. Makes application of this Act prospective. SECTION 5.Emergency clause.
