BACKGROUND AND PURPOSE 

Currently, many county clerks have already converted paper records to
computerized fee and cash management systems.  H.B. 1169 allows officers
collecting fines or fees to maintain computerized records of these fees and
authorizes the county auditor to access them electronically. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Article 103.010, Code of Criminal Procedure, by adding
Subsection (c), to authorize each officer collecting fines or fees in
criminal cases to record the amount of money paid, the date the money was
paid, the style and number of the case in which the costs were accrued, the
item of costs, and the name of the person paying the money, on a computer,
rather than in a receipt book.  Requires the officer to provide a receipt
to each person paying a fine or fee. 

SECTION 2.  Amends Article 103.011, Code of Criminal Procedure, to
authorize the county auditor to electronically access of records contained
in the computer database in accordance with Article 103.010, Code of
Criminal Procedure, as amended by this Act, and to keep a copy of the
computer generated receipt records used in the audit.  Makes conforming and
nonsubstantive changes. 

SECTION 3.  Emergency clause.
  Effective date: upon passage.
