DIGEST 

Currently, designated superfund sites are dangerous areas.  H.B.  1265
defines a facility classified as a superfund site and increases the
punishment for trespassing on such a site. 

PURPOSE

As proposed, H.B. 1265 defines "superfund site" and creates a Class A
misdemeanor for an offense committed on a superfund site. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 30.05(b), Penal Code, by adding Subdivision (5),
to define "superfund site" as a facility that is on the National Priorities
List or the state registry. 

SECTION 2.  Amends Section 30.05(d), Penal Code, to clearly set forth
conditions under which an offense under this section is a Class A
misdemeanor.  Makes conforming changes. 

SECTION 3.  Makes application of this Act prospective.

SECTION 4.  Effective date:  September 1, 1999.

SECTION 5.  Emergency clause.
