SRC-JXG H.B. 1291 76(R) BILL ANALYSIS Senate Research Center H.B. 1291 76R172 MCK-FBy: Brimer (Harris) Natural Resources 5/14/1999 Engrossed DIGEST Currently, Texas law authorizes a city to take over a nonprofit water supply or sewer service corporation and special utility districts within its boundaries for single certification process. However, a city is prohibited from annexing fresh water supply districts that provide similar services. H.B. 1291 would allow cities to annex fresh water supply districts for single certification purposes. PURPOSE As proposed, H.B. 1291 allows single certification of water or sewer utilities in an incorporated or annexed area by a municipality. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 13.255(j), Water Code, to require this section to apply only in a case where the retail public utility that is authorized to serve in the certified area that is annexed or incorporated by the municipality is a nonprofit water supply or sewer service corporation, or a fresh water supply district under Chapter 53, Water Code. Makes a conforming and nonsubstantive change. SECTION 2. Emergency clause. Effective date: upon passage.
