HBA-NLM, PDH H.B. 1291 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1291 By: Brimer Land & Resource Management 4/21/1999 Introduced BACKGROUND AND PURPOSE Current law authorizes a city to take over a non-profit water supply or sewer service corporation and special utility districts within its boundaries for single certification purposes. However, a city is prohibited from annexing fresh water supply districts that provide similar services. H.B. 1291 applies Section 13.255 (Single Certification in Incorporated or Annexed Areas), Water Code, to a fresh water supply district under Chapter 53 (Fresh Water Supply Districts), Water Code. The application of this section allows cities to annex fresh water supply districts for single certification purposes. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 13.255(j), Water Code, to add a fresh water supply district under Chapter 53 (Fresh Water Supply Districts), Water Code, in the list of organizations to whom this section applies. Makes a nonsubstantive change. SECTION 2.Emergency clause. Effective date: upon passage.
