BACKGROUND AND PURPOSE 

For more than 100 years, Texans have celebrated June 19th, or Juneteenth,
as Emancipation Day, the day that African-American slaves gained the
freedom nominally granted to them by the Emancipation Proclamation.  The
66th Texas Legislature designated June 19th as an official state holiday.
In accordance with Section 448.031, Government Code, which requires the
Texas Emancipation Juneteenth Cultural and Historical Commission to
establish a Juneteenth memorial monument, H.B. 1368 designates the location
of the Emancipation memorial  monument to be on State Capitol grounds.      

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Subchapter B, Chapter 448, Government Code, by adding
Section 448.034, as follows: 

Sec. 448.034.  LOCATION OF MONUMENT.  Requires the site of the monument
established under this chapter (Texas Emancipation Juneteenth Cultural and
Historical Commission) to be on the State Capitol grounds.  Provides the
"State Capitol grounds" means the area south of the Capitol, north of 11th
Street, and inside the historic cast-iron fencing. 

SECTION 2.Emergency clause.
  Effective date: upon passage.
